KRISPY KRUNCHY FOODS PRIVACY POLICY

This Krispy Krunchy Foods Privacy Policy describes how Krispy Krunchy Foods LLC (“Krispy Krunchy Foods,” “we,” “our,” or “us”) collects, uses, and discloses information about you.  This Privacy Policy describes the personal information we collect, how we use it, with whom it is disclosed, the purpose of such disclosures, and the rights you may have available to you regarding your personal information.  This Privacy Policy covers personal information collected when you access or use our websites and other online products and services, or when you otherwise interact with us where we provide this Privacy Policy (collectively, “Services”).  In some circumstances, we may provide different or additional notices of our privacy practices associated with a specific product or Services you obtain from us, the capacity in which you engage with us, or different laws that may apply.

We work with a third-party payment processor that collects and processes payment information, and we do not directly handle your payment card information.

We may use the personal information to create de-identified, anonymized, or aggregated information that no longer identifies or relates to a specific person.  We use such information in accordance with applicable law.  We may also use the personal information we collect or that is collected on our behalf to comply with legal and financial obligations and/or to carry out any other purpose described to you at the time the information was collected.

USES OF PERSONAL INFORMATION

As described above, we process your personal information for the following business purposes:

  • Provide the Services and customer service, including maintaining and servicing accounts, improving and developing products and Services, troubleshooting, and processing or fulfilling transactions.
  • Communicate with you about the Services and products, such as responding to communications, contacting you about your transactions, or to market our products and Services.  If you contact our customer services representatives, we will use information about you to help you resolve a problem or answer your question.
  • Prevent fraud, protect and enforce our legal rights, and otherwise comply with law, such as protecting the rights of individuals, employees, and Krispy Krunchy Foods, as well as preventing loss, fraud, abuse, illegal use, and other misuse or violation of our Terms and Conditions.  We also will use information to comply with applicable law, such as proceedings, process, court orders, or governmental requests.
  • Improve our offerings and understand how you interact with the Services, such as data analysis or operating and maintaining the safety, security, and integrity of the Services, databases, and other technology assets.
  • Personalize and understand your experience, such as your personal or professional interests, demographics, user experience with us, and contact preferences, as well as to customize offers to your interests.
  • Assess your job application, such as verifying information and conducting background checks (where applicable).
  • Creating, managing, and administering your account.
  • Any other purpose with your consent.

DISCLOSURE OF INFORMATION

We disclose personal information to the following categories of recipients for the relevant business purposes or as otherwise described in this policy:

  • In accordance with, or as required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.
  • If we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of Krispy Krunchy Foods, our users, the public, or others.
  • In connection with, or during negotiations concerning, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.  If required by law, we will separately notify you of such transfer.
  • Between and among Krispy Krunchy Foods and our current and future parents, affiliates, and subsidiaries and other companies under common control and ownership to provide our product and Services offerings.
  • In connection with service providers, contractors, and other third parties that perform services on our behalf or assist us with our business purposes described above, including completing your transaction, marketing campaigns, targeted advertisements, and technical support.  We may engage third parties to act as our service providers and perform certain tasks on our behalf including, but not limited to, analyzing customer data, providing marketing assistance, processing payments, and processing or storing data in connection with your use of our Services.
  • With your consent or at your direction.

We also disclose aggregated or de-identified information that cannot reasonably be used to identify you.

ANALYTICS AND YOUR CHOICES

Third-party tracking & websites.  The Services may also contain links to other websites that are not controlled by us.  These links are made available to you as a convenience, and you agree to use these links at your own risk.  Krispy Krunchy Foods disclaims any responsibility for the privacy practices or the content of such other websites.  If you navigate to a third-party website from our Services, we strongly encourage you to review and become familiar with that third-party website’s own privacy notice and statements.  

In some cases, you may need to provide personal information on these third parties’ websites in connection with our Services, such as when you apply for employment with us.  By participating in or using such functions, you understand that the personal information you provide to such third parties may not be subject to this Privacy Policy, unless expressly stated otherwise.  Please refer to the privacy policies of such third parties before providing them with your personal information.

Cookies.  The Services uses cookies, and other similar technologies such as pixels and beacons, from third parties and service providers to help personalize your online experience, remember your preferences, analyze the use of the Services, advertise our Services to you, and maintain security of the Services.  Cookies help us understand how users interact with our Services, including date and time of visits, pages viewed, amount of time spent using our digital offerings, or general information about the device used to access our Services.  Information related to these actions and technologies are automatically transmitted by your browser to us.  Through the use of cookies and other similar technologies, information about video materials or services you engage with on the Services may be disclosed incidentally in the ordinary course of business.  

We may also share information that we collect through these technologies with third parties, such as service providers, advertisers, and social media sharing companies as described in this Privacy Policy.  Certain third-party content providers, advertisers, and advertising companies may also place cookies or other similar technologies on your computer or mobile device.

Web beacons and pixels allow us to count users who have visited various pages on our Services.  We may include web beacons in promotional email messages in order to determine whether messages have been opened and acted upon.  Third parties may also deliver and use web beacons.  While some may be used to support customizing advertising to you, others may be used to protect legal rights to content provided on our Services, such as protecting the copyright to a photograph or video.

When you use social media platforms, applications, or tools that enable features like audio or video content (sometimes known as “plugins”), or other features that are operated or offered by third parties and are integrated into our Services or allow you to connect to our Services, we may collect information from those third parties.  This may include payment services, login services, or review platforms.

Do Not Track.  Some browsers support a “Do Not Track” feature, which is intended to be a signal to websites that you do not wish to be tracked across different websites you visit.  Websites operated by Krispy Krunchy Foods do not currently respond to those signals.  If you block or reject cookies, not all of the tracking described here will stop.  Third parties that have content embedded on the Services such as social media plugins may obtain information about the fact that a web browser visited the Services.  You can learn more about “Do Not Track” here and how to limit third-party use of your information for interest-based advertising here.

Email Choices: You may opt out of marketing or advertising emails by following the unsubscribe process included in any promotional email you received.  You may also request to opt out of marketing or advertising emails by contacting us at privacy@krispykrunchy.com.  Please keep in mind that if you opt out of receiving marketing messages, you will still receive transactional and service-related emails from us (such as emails related to your purchase, password reset requests, reminder emails you have requested, updates to our terms and policies, and other similar communications essential to your transaction) that may be necessary for us to make the Services available to you or respond to your inquiries. 

SECURITY

We work to protect your personal information from unauthorized access by using commercially reasonable security safeguards along with security procedures and practices.  Although Krispy Krunchy Foods employs measures to maintain security, we cannot guarantee that your information will not be intercepted by third parties’ illegal efforts.  It is your responsibility to maintain the privacy of the information you are transmitting to us or any account you maintain with us.  Please keep all information and any usernames and passwords in a safe and secure place.  

CHILDREN UNDER THE AGE OF 18

The Services are not intended for children under the age of 18 years of age.  No one under the age of 18 may provide any personal information to the Services and we do not knowingly collect, sell, or share personal information directly from children under 18.  If you believe we might have collected personal information from a child under 18 inadvertently, please email us at the email address provided in the Contact Us section below.

  • We disclose Identifiers, Customer Records, Commercial Information, and Internet or other electronic network activity information with service providers performing services on our behalf and third parties, advertising networks, and those to whom you consent to or direct we provide your information.
  • We disclose Identifiers, Customer Records, and Commercial Information, and Education, Professional, and other Employment-related Information with service providers providing services on our behalf, including identity verification providers, payment risk vendors, and fraud prevention partners.
  • We disclose Internet or other electronic network activity information with internet service providers providing services on our behalf, including data analytics providers, operating systems and platforms, marketing service providers, mapping integration providers, and fraud prevention partners.  
 

Right to Opt Out of Sale/Sharing/Targeted Advertising

In the preceding twelve (12) months, Krispy Krunchy Foods has not knowingly “sold” or “shared” your personal information.

However, our Services use cookies and other online tracking technologies that may be considered a “sale” or “sharing” under applicable law.  Categories of personal information disclosed that may be considered “sale” or “sharing” include, Identifiers and Internet or other electronic network activity information.

Categories of third parties to whom personal information was disclosed that may be considered “sale” or “sharing” include certain advertisers and marketing partners, data analytics providers, and social media networks.  

You may opt out of the sale/sharing of your personal information by changing your cookie preferences on our website. To change your preferences, please click on the cookie icon in the lower right corner of our page.

Right to Access, Know, and Correct

You may submit a request to access the personal information we maintain about you, a request to know what personal information is maintained about you, and/or a request to correct any personal information maintained by Krispy Krunchy Foods.  Once we receive your request and confirm your identity, we will disclose to you:

  • The categories of personal information collected about you and the sources from which we collected such information.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
    • Sales, identifying the personal information categories; and 
    • Disclosures for a business purpose, identifying the personal information.  
  • The specific pieces of personal information we collected about you.
 

Right to Delete

You may have the right to request that Krispy Krunchy Foods delete any personal information collected and retained, subject to certain exceptions.  Once we confirm your identity, we will review your request to understand if an exception applies to your request.  We may deny your deletion request if retaining the information is necessary for us or our service provider(s) and as permitted by applicable law.  We will delete or deidentify personal information not subject to an exception from our records and will direct our service providers to take similar action.

Retention of Personal Information

We will retain your personal information for a period we believe reasonable to fulfill the purposes for which we hold your personal information, as outlined in this Privacy Policy, unless a longer retention period is required or permitted by law.

The criteria used to determine our retention periods include:

  • The length of time we have an ongoing relationship with you and provide the Services to you;
  • Whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); and
  • Whether retention is advisable considering our legal position (such as for statutes of limitations, litigation, or regulatory investigations).
 

Exercising Your Rights

You may make these requests by sending an email to privacy@krispykrunchy.com or calling us at (888) 715-1950.  If we need to further verify your request, we may do so by asking you to provide information related to your interactions with us.

Right to Appeal

Residents of certain states may have the right to appeal our decision with respect to a request.  If we deny your request, you may appeal our decision by contacting us at privacy@krispykrunchy.com, (888) 715-1950, or 1000 Marietta Street NW. #244 Atlanta, Georgia 30318.  If you have concerns about the result of an appeal, you may contact the attorney general in the state where you reside.

Your request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include:

  • Providing sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and
  • Describing your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  

You do not need to create an account with us to submit a request.  We will only use personal information provided in the request to verify the requestor’s identity or authority to make it.  

Authorized Agents

Only you or your authorized agent may make a consumer request related to your personal information.

If we receive your request from an authorized agent and they do not provide a valid power of attorney, we may ask the authorized agent to provide proof that you gave the agent signed permission to submit the request to exercise rights on your behalf.  In the absence of a valid power of attorney, we may also require you to verify your own identity directly with us or confirm to us that you otherwise provided the authorized agent permission to submit the request.  If you are an authorized agent seeking to make a request, please submit the following to privacy@krispykrunchy.com:

  • A copy of a power of attorney provided to you by the consumer pursuant to applicable law; or
  • Proof of signed permission along with a copy of your ID and have the consumer directly confirm with us that they provided you permission to submit the request by sending an email.
 

Response Timing and Format

We will acknowledge a consumer request within 10 days of receipt, where applicable law requires, and we will respond to a consumer request within 45 days of its receipt.  If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

Any disclosures we provide may only cover the 12-month period preceding our receipt of your request.  The response we provide will also explain the reasons we cannot comply with a request, if applicable.  For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.  If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.  

Non-discrimination and No Retaliation

We will not discriminate against you for exercising any of your rights.  

California’s Shine the Light

Under California’s “Shine the Light” law, California residents who provide personal information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us once a calendar year information that includes a list of all third parties to which Krispy Krunchy Foods has disclosed personal information, as defined in California Civil Code Section 1798.83(e) during the preceding year, if any, with other businesses for their own direct marketing uses.  If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year.  While we do not knowingly disclose personal information to third parties for their direct marketing purposes, California residents may request this information in writing by contacting us by email to privacy@krispykrunchy.com with “California Privacy Request” in the subject line.  In your request, please attest to the fact that you are a California resident and provide a current California address for your response.
