High Level Terms from Contracts
The below information is only meant to serve as a high-level guide for Operators as it relates to the OLO, Stratix and DoorDash contracts between Krispy Krunchy Foods and those three companies. This guide is not intended to be legal advice and is not exhaustive of the terms in each of these contracts. Please refer to each contract for more information on the terms; email delivery@krispykrunchy.com to review the Krispy Krunchy Foods’ Master Service Agreements with OLO, DoorDash, UberEats or GrubHub.
OLO
The first 1,300 Operators who sign up to use OLO will be charged $52.50/month starting January 1, 2025 for 3PD menu management (RAILS). After April 1st, 2025, Operators will be charged $99.00/month for both the 3PD menu management (RAILS) & owned-channel ordering through September 30, 2028 unless they cancel their service.
- The $52.50/month fee is covered by Krispy Krunchy Foods for no later than 3/31/25 if claimed by 2/14/25.
- Billing begins upon installation.
- After September 30, 2028, OLO may increase the price.
If a prior Operator uses OLO and transfers the store location to a new Operator, OLO will charge the new Operator $75 as a transfer fee.
Stratix
The first 1,300 Operators who sign up for OLO before 2/14/25 will receive a free iPad and quick release kiosk with charging case from Krispy Krunchy Foods and three years of service on the hardware for the OLO Menu Management Program*
After supply runs out or after 2/14/25, whichever comes first, Operators who sign up for OLO will pay $420.56 for an iPad, $189.00 for the charging case, and $352.08 for three years of hardware service of the OLO Menu Management Program.
All Operators have the option to buy a printer for $295.00 and three years of support for $206.67.
*Operators who receive free equipment and service from Krispy Krunchy Foods must comply with the following while they are a part of the Krispy Krunchy Foods® program: 1) carry Krispy Krunchy Foods’ core seven products, 2) carry only Krispy Krunchy Chicken approved menu items on the Operator’s menu, and 3) keep the Krispy Krunchy Chicken® program open until and available to receive third-party delivery orders until 8 pm on Fridays and Saturdays.
DoorDash
If DoorDash is Operator’s first and sole third-party food ordering and/or delivery provider or platform, Operators may not include KKF products on any other third-party food ordering and/or delivery provider or platform for 90 days following the date operator launches third-party delivery on DoorDash.
Starting Rates:
The below Starting Rates will apply but are subject to change based on certain criteria as outlined in the Master Services Agreement between DoorDash and Krispy Krunchy Foods.
Marketplace Delivery Commission Rate: 23%
DashPass Commission Rate: 24%
Pick-Up Commission Rate: 6%
The Standard Rates are:
If certain criteria are not met, the rates may be adjusted to reflect the Standard Rates:
Marketplace Delivery Commission Rate: 25%
DashPass Commission Rate: 25%
Pick-Up Commission Rate: 15%
The Standard rates may be lowered depending on different factors as explained in the Master Services Agreement between Krispy Krunchy Foods and DoorDash, but will not go below:
Marketplace Delivery Commission Rate: 21.5%
DashPass Commission Rate: 23.5%
Pick-Up Commission Rate: 6%
At some point in the future, DoorDash will create a Marketing Fund Product. Before that Product is available, operators agree to use their best commercially reasonable efforts to invest 5% of the previous quarter’s sales on DoorDash Marketplace in app advertisements and promotions with DoorDash and promotions offered by DoorDash. On the Product becomes available, operators agree to invest 5% of the previous quarter’s sales on the DoorDash Marketplace in-app advertisements and promotions with DoorDash and promotions offered by DoorDash.
